Arbitration – The process of dispute resolution in which a neutral third party, arbitrator, renders a decision after a hearing at which both parties have had an opportunity to be heard.

Arbitration Agreement – A clause inserted in a contract providing for compulsory arbitration in case of dispute as to rights or liabilities under such contract.

Business Owner's Policy (BOP)– Combines property and liability protection for the daily operating exposures associated with running a medical practice.

CAP Cares - An early intervention program designed to assist members in managing adverse outcomes arising from patient care.

CAPsules – A monthly publication for our members.

CME – Continuing Medical Education.

CME Program – A risk management program accredited by the Institute for Medical Quality/California/California Medical Association (IMQ/CMA) to provide continuing medical education for physicians.

Critical Care Insurance – Provides a lump sum payment upon the diagnosis of a covered medical condition e.g. cancer.

Directors and Officers Liability (D&O) – Protects directors, officers and the entity against liability exposures associated with the operation of corporate entities and partnerships.

Disability Insurance – Pays an insured person a monthly income when unable to work because of an accident or illness.

E

Employment Practices Legal Defense (EPD)– Provides coverage to active CAP members to help cover legal defense costs associated with employment related lawsuits.

ERISA Bond – Required by law if an employer provides employees with pensions or retirement (401K) plans.

Errors and Omissions Liability (E&O)– Provides protection to physicians who perform consulting activities apart from medical care of patients. Services such as: court-ordered child custody and child abuse evaluations; reviewing medical records for insurance companies; evaluating defendants in criminal cases; providing an expert medical opinion in a civil trial; performing peer review, credentialing, or utilization management for a third party.

Evaluation – To determine the significance, worth, or condition of usually by careful appraisal and study.

Group Disability Insurance – Provides $1,500 a month in disability insurance for one year to help with the loss of income in the event a member becomes disabled. Benefits are payable after the 91st day of disability, or after the 31st day for pregnancy-related claims.

Life Insurance – Upon death, this coverage pays money to a designated beneficiary.

Long-Term Care Insurance (LTC) – Because of old age, mental or physical illness, or injury, some people find themselves in need of help with eating, bathing, dressing and other physical activities. This coverage can help pay for such care in the future, in the event you are faced with the need for assistance.

MEDefense – Provides coverage for legal defense costs arising from inquiries by the Medical Board of California, allegations of Medicare/Medicaid fraud and abuse, or alleged non-compliance with HIPAA or EMTALA regulations.

MEDefense Plus – Provides coverage for legal defense costs and reimbursement of fines and penalties arising from inquiries by the Medical Board of California, allegations of Medicare/Medicaid fraud and abuse, or alleged non-compliance with HIPAA or EMTALA regulations.

Member – An eligible physician approved by the Quality Control Committee who returns written notification of approval, a signed acknowledgement of acceptance.

Mutual Protection Trust (MPT) – Medical professional liability protection.

Retroactive – Extending in scope or effect to a prior time or to conditions that existed or originated in the past.

Revoke – To annul by recalling or taking back, rescind.

Risk – Possibility of loss or injury.

Risk Management – The expert management of differences that may exist between expectations and reality. An awareness of potential risk.

Risk E-Notes – A biweekly e-mail communication that is sent to our members’ primary office contacts plus CAP group administrators.
