Employment Practices Defense Coverage Guides Members through the Law

As you’ve probably learned, CAP has reduced assessments across-the-board by 5% for 2006. And you should know these savings come with no reduction in the value-added services you enjoy as a CAP member. Your EPD (Employment Practices Defense) insurance is a good example.

Once again for 2006, CAP has negotiated a special group rate on EPD insurance to help cover your legal costs if you are the subject of a lawsuit arising from your actions as an employer. You don’t have to do anything to secure this coverage; you already enjoy it, as a member in good standing.

Your EPD protection covers legal defense costs for most employment-related lawsuits up to $50,000 as an individual physician (limits are higher for groups) with a $5,000 deductible and a 25% co-payment—and the co-payment is waived if you choose an attorney from a recommended list.

This coverage includes a Hotline service you can access if you have a question about the legal validity of an employee’s complaint, or how to handle a situation that might lead to a claim. An important innovation provided to all CAP Members in 2006 is the CAP Human Resources (HR) Helpline, which can be accessed through the “Members Only” section. The Helpline contains valuable HR information, employment policies and guidelines for you to browse or download.

Employment related suits are the fastest growing civil cases in the United States. Over 70% of cases are resolved in favor of the defendant. During the 1990s, U.S. companies paid more than $1billion in expenses related to employee claims, and the average jury award nearly quadrupled during the decade. That’s why we are glad to provide you with automatic EPD insurance, as well as optional EPLI to cover the potential cost of a legal judgment against you.
