Reducing Costs by Preventing Loss

Risk management and loss prevention, familiar subjects to corporate financial officers, are now gaining new respect among physicians. Fewer losses (i.e., fewer liability claims paid) can mean lower costs for malpractice coverage. Fewer claims also means fewer distractions from your business—and less time away from the office in attorney meetings, depositions and the courtroom.

That's why the Cooperative of American Physicians (CAP) makes available a number of general and specialty-specific risk management tools and services. They are available as part of membership in the Cooperative, but can also be accessed at reasonable cost by non-member organizations wishing to increase risk awareness in their staffs. These programs include:

Risk Management Continuing Medical Education Seminar.

This three-hour CME seminar for physicians is accredited by the California Medical Association. Topics include: elements of malpractice, malpractice climate in California, claims experience, legal protection for physicians, the arbitration alternative, physician-patient relationships, patient advocacy, informed consent, medical records, medication, and patient tracking/recall issues.

After a typical CAP Risk Management Seminar, attendees will:

  1. Understand the legal components of medical negligence.
  2. Realize why informed consent and physician/patient communication and rapport are their first line of protection from claims.
  3. Know the components of a complete and defensible medical record.
  4. Identify do's and don'ts for physicians receiving notice of medical negligence suits.
  5. Understand the advantages of arbitration over traditional courtroom dispute resolution.

In 1996, CAP received the Samuel R. Sherman, M.D. Award from the California Medical Association's Committee on Continuing Education for its educational programs. This was the first time the award had been won by an organization rather than a health care group.

Office Staff Risk Management Seminars.

Regional seminars for staff and office managers cover pertinent practice issues. Topics include: Medical records retention and release, staff charting, confidentiality, patient complaint management, tracking/recall of high risk patients, and arbitration agreement usage. Programs can be customized to meet specific needs.

Arbitration Inservice Program.

This program assists physicians and office staff in the implementation and use of arbitration agreements.

On-Site Consultation for Medical Office Practices.

Office visits by a qualified professional address specific risk management issues. Telephone consultation is then available on a follow-up basis.

Practice Evaluation Program.

Risk Management Representatives visit the office to conduct an assessment of areas of potential liability. This assessment includes an evaluation of the following: medical records, patient tracking systems, confidentiality, and laboratory report tracking/follow-up. After receiving an "office risk profile," the physician works with CAP staff to implement risk management strategies.

Risk Management Tools and Services.

A variety of books, forms and specialty-specific risk management tools are available—including arbitration agreements, patient consent forms, breast mass documentation kits and many more.
